These Terms of Service ("Terms") govern your access to and use of the NoxMC website, Minecraft server, Discord community, store, and related services (collectively, the "Services"). The Services are operated by ByteExecLab, LLC ("ByteExecLab," "NoxMC," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

2. Eligibility and Accounts

You must be able to enter into a legally binding agreement to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the permission of a parent or legal guardian.

To access certain features, you must register an account through a Microsoft account. We do not offer account registration by standalone username, email, or password.

After registering through Microsoft, you may be able to connect additional third-party accounts, such as Discord and/or Steam, as alternate login methods or connected identities.

You are responsible for:

maintaining control of your Microsoft account and any linked third-party accounts;
ensuring your linked account information is accurate and current; and
all activity that occurs through your account or linked identities.

We may suspend or terminate accounts, linked identities, or access to any part of the Services at our discretion for violations of these Terms, suspected fraud, abuse, security risks, or chargeback activity.

3. Description of Services

NoxMC provides online game-related services, including a Minecraft server, website, community services, and digital purchases such as ranks, upgrades, and related virtual benefits sold through our website.

We may modify, suspend, discontinue, or remove any portion of the Services, content, rank, upgrade, feature, or benefit at any time, with or without notice.

4. Purchases, Digital Items, and Payment Processors

NoxMC sells digital goods and benefits, including ranks and upgrades, through its website.

Payments may be processed by third-party payment providers, including:

PayPal
Stripe
Crypto.com

By making a purchase, you authorize the applicable payment processor to process your transaction according to its own terms and privacy practices.

You are responsible for ensuring that your payment method is valid and that you are authorized to use it.

4.1 Digital Nature of Purchases

All purchases through the Services are for digital goods, virtual benefits, or access-related features. Unless otherwise expressly stated by us in writing, purchases are provided for use within the NoxMC ecosystem only and do not grant any ownership interest in the Services or in any software.

4.2 No Guarantee of Continued Availability

Ranks, upgrades, features, virtual items, server access, or associated benefits may be changed, rebalanced, limited, or removed at any time. Purchase of a digital item or benefit does not guarantee perpetual availability or uninterrupted access.

5. Chargebacks, Payment Disputes, and Reversals

If a user initiates or participates in a chargeback, payment dispute, reversal, or similar claim relating to any purchase made through the Services, the affected purchase may be immediately suspended, and the user’s access may be revoked across all NoxMC platforms, including but not limited to:

the website;
the Minecraft server; and
the Discord community.

Any such dispute is treated by NoxMC as a material violation of these Terms and of our payment policies.

Disputes are non-negotiable under NoxMC policy. If a payment dispute or chargeback is filed, NoxMC may revoke access immediately, and there may be no option to resolve, reinstate, or reverse that action except where required by applicable law.

Submitting a support ticket does not guarantee any refund, reinstatement, or resolution.

6. Refunds

Because NoxMC sells digital goods, virtual benefits, and access-related services, all sales are generally treated as final unless otherwise required by applicable law or expressly approved by us in writing.

Nothing in this section limits any non-waivable consumer rights that may apply under applicable law.

7. Rules of Conduct

You agree not to:

violate any applicable law or regulation;
exploit bugs, cheats, automation, or unauthorized tools;
engage in fraud, abuse, harassment, threats, hate speech, or disruptive conduct;
attempt to gain unauthorized access to accounts, systems, networks, or data;
interfere with the operation, security, or integrity of the Services;
impersonate another person or misrepresent affiliation with any person or entity;
use the Services for commercial exploitation without our written permission; or
violate the rules, policies, or posted guidelines applicable to the Minecraft server, website, Discord, or any related community space.

We may monitor compliance and take any enforcement action we consider appropriate, including warnings, suspension, termination, content removal, access revocation, or reporting to payment providers or law enforcement.

8. Community Platforms and Third-Party Services

Certain aspects of the Services may rely on or interact with third-party platforms and providers, including Microsoft, Discord, Steam, PayPal, Stripe, Crypto.com, and other service providers.

Your use of third-party platforms is subject to their own terms, policies, and availability. We are not responsible for third-party services, outages, actions, content, or account decisions.

9. Intellectual Property

All content, branding, software, server content, website design, text, graphics, logos, and other materials made available through the Services are owned by ByteExecLab, LLC, its licensors, or other respective rights holders, and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use only.

You may not copy, reproduce, distribute, modify, reverse engineer, sell, resell, or exploit any part of the Services except as expressly allowed by law or with our prior written permission.

10. Suspension and Termination

We may suspend, restrict, or terminate your account, purchases, entitlements, or access to any part of the Services at any time, with or without notice, for any reason including suspected fraud, abuse, security concerns, policy violations, payment reversals, or operational needs.

Upon termination or suspension:

your right to access and use the Services may immediately cease;
your ranks, upgrades, or digital entitlements may be removed or disabled; and
linked platform access, including Discord, website, and server access, may be revoked.

11. Availability and Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ByteExecLab, LLC disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free service.

We do not guarantee that:

the Services will be available at all times;
the Services will be secure, error-free, or free of harmful code;
ranks, upgrades, or virtual benefits will always remain available; or
defects or interruptions will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, ByteExecLab, LLC and its owners, managers, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, or virtual items, arising out of or related to your use of or inability to use the Services.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to NoxMC for the specific purchase giving rise to the claim during the twelve (12) months preceding the event giving rise to liability.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless ByteExecLab, LLC and its affiliates, personnel, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

your use of the Services;
your violation of these Terms;
your violation of applicable law; or
your infringement of any third-party rights.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.

To the extent permitted by law, any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the website with a revised effective date or last updated date. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
